Privacy Policy

Žilíkstav, s.r.o. with its registered office in Hrkovce, Hrkovce 58, postcode 936 01, ID No.: 47 495 235, as the controller processes personal data of its business partners insofar as they are natural persons, as well as statutory representatives, persons authorized by the business partner to certain negotiations within the framework of contractual relations and contact persons of business partners and potential business partners.

In particular, our company processes the following personal data of business partners and their employees:

  • first name, last name, job title, phone number, email contact, other electronic contact (e.g. Skype name, social network name, etc.), signature,
  • Information about the contractual relationship with the business partner and the actions of the business partner's employee within the contractual relationship (e.g. account number of the business partner, registration number of the motor vehicle of the contract carrier), documents issued, endorsed or signed by the business partner's employee, record/record of communication/negotiation with the business partner's employee,
  • audio-visual recordings made in our company's protected premises/facilities which show the appearance, activities and expressions of a business partner or an employee of a business partner.

This personal data is processed by our company to the extent necessary and for the purposes set out below:

  • issuing and keeping records of accounting and tax documents and their supporting documents (fulfilment of legal obligations),
  • performance of contractual obligations and exercise of contractual rights (performance of the contract and the legitimate interest of our company),
  • keeping records of contractual partners and potential contractual partners (legitimate interest of our company),
  • Establishing, maintaining and deepening business relationships and business development, e.g. sending gifts, greetings, business and non-business offers (legitimate interest of our company),
  • protecting property, dealing with damage, establishing, exercising and defending our potential legal claims, preventing crime and ensuring security in the monitored premises (for example, to prevent theft or to ensure the security of the personal data processed), which we consider to be a legitimate interest of our company.

Your personal data may be disclosed to the following recipients to the extent necessary:

  • public authorities conducting administrative proceedings or exercising public control, in particular financial authorities, the SK Police, etc.,
  • third parties providing our company with the administration and hosting of information systems and software applications, property management (including access control), security services, legal assistance, economic and financial consulting and auditing (all such persons are bound by strict confidentiality obligations).

Your personal data will be processed for the above purposes for:

  • for the duration of the contractual relationship with the business partner and for a period of 4 years from the date of termination of such contractual relationship (for business partners),
  • for a period of 4 years from the date of obtaining contact details from the potential business partner or its employee (for potential business partners),
  • for accounting and tax documents and supporting documents issued for the statutory period (5 years for accounting documents and 10 years for tax documents),
  • for audiovisual recordings for 7 years from the date of the recording (for audiovisual recordings made at places where goods are dispatched, for 21 days) and, if we take legal action on the basis of such recording, for 4 years for the establishment, exercise and defence of our legal claims.

What rights do you have in relation to the processing of your personal data for this purpose?

  • Upon your request, we will inform you whether our company processes your personal data. If we are processing it, you have the right to be provided with a copy of the personal data we are processing or to otherwise have access to it.
  • You also have the right to be informed about what data we process about you, for what purposes, the recipients to whom we provide it, the duration of its processing, and the sources from which the data originate.
  • Furthermore, you have the right to have your non-transmitted personal data corrected or your incomplete data completed.
  • In the cases provided for by law, you have the right to have the personal data processed about you deleted by our company (e.g. in the event of withdrawal of your consent). However, we will not erase personal data that we strictly need for the performance of our legal obligations, for the performance of a contract, for the protection of our legitimate interests or for the establishment, exercise and defence of our legal claims.
  • In cases provided for by law, you have the right to have our company temporarily restrict the processing of your personal data. You have the right to request the transfer of your personal data that you have provided to us to another controller.
  • If we process your personal data on the basis of our legitimate interests, you have the right to object to such processing (please inform us that you do not consent to such processing).
  • If you believe that we are violating applicable law in processing your personal data, you have the right to ask us to explain and correct the error or file a complaint with the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava.

Žilíkstav, s.r.o. with its registered office in Hrkovce, Hrkovce 58, Postal Code 936 01, ID No.: 47 495 235, as the controller, obtains and processes personal data of the data subjects, to whom it hereby provides information within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“GDPR“) and with regard to Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain acts (“ZOOÚ“).

Cookies are small text files that your web browser stores or retrieves on the hard drive of your end device (e.g. computer, laptop or smartphone) through the websites you visit for the purpose of storing certain information or image files such as pixels. The next time you visit our website on the same device, your cookie information will already be stored. Cookies are passed either to our website („own cookie“) or to another website to which the cookie belongs („external cookie“ or „third party cookie“). If you visit our website from a device other than the device on which you have already set a cookie or if there is a change in the cookie handling process (e.g. modification of the time limit, etc.) you will be asked to set your cookies again on our website i.e. for example to provide your consent and/or to set your preferences. Žilíkstav, s.r.o. currently only has its own cookies.

We process cookies for a variety of purposes, but primarily we use them to be able to display our website in an optimal way for you, to ensure the proper functionality of our website in accordance with your preferences.

From an OA protection perspective, it is important to assess what data is contained in a particular cookie. If the data contained in the cookie includes any identifier which, alone or in combination with other data, is capable of directly or indirectly identifying a natural person - the user of the web browser, such cookie will have to be considered as PII within the meaning of Article 4(1) of the GDPR.

According to the type of relationship with the controller, the table below lists the purposes of the processing of personal data (hereinafter referred to as “PII“), which shows the category of data subjects, the legal basis for their processing, the categories of PII to be processed, as well as the period of time for which the controller will process such PII.

Purpose of the processing of personal data: NON-INVALID COOKIES. The purpose of the processing is to transmit or facilitate the transmission of a message via a network or, if this is strictly necessary for the controller as an information society service provider, to provide an information society service that is explicitly requested by the website user.

Legal basis for the processing of personal data: article 6(1)(c) of the Regulation - Legal obligation Act No.452/2021 Coll.

Category of data subjects: website visitors/users

Period of processing of OA: The period is adjusted for the specific cookie

Recipients or category of recipients: subjects to whom the controller provides personal data on the basis of the law; professional consultants and advisors who are bound by a legal and/or contractual obligation of confidentiality; website management company.

Purpose of the processing of personal data: exercise of the data subject's rights

Legal basis for the processing of personal data: the processing is necessary for the fulfilment of the legal obligation of the controller arising from the Regulation and from Act No 18/2018 Coll., pursuant to Article 6(1)(c) of the Regulation.

Category of data subjects: natural persons exercising their rights as data subjects

Period of processing of the CP: 5 years following the year in which the application was processed

Recipients or category of recipients: entities to which the controller provides personal data on the basis of the law

Which countries do we transfer your personal data to?
‍Transfers to third countries are not made and no automated individual decision-making, including profiling, takes place.

Where the legal basis for the processing of personal data is the law, the provision of such data is a legal requirement. In the event of failure to provide this data, it is not possible to ensure the proper performance of the obligations of Žilíkstav, s.r.o. arising from the relevant general legislation. In this case, the website of the operator would not function in the event of non-provision of personal data.

In particular, the data subject has the following rights in relation to the processing of personal data:

1) upon request, to request from ŽILÍKSTAV, s.r.o. confirmation of whether or not personal data are processed (access to personal data), under what conditions, including the scope, purpose and duration of processing, and information on the source of obtaining the personal data concerned;

2) upon request, require ŽILÍKSTAV, s.r.o. to correct incorrect or outdated personal data or to complete incomplete personal data;

3) upon request, require ŽILÍKSTAV, s.r.o. to delete/eliminate personal data if:

(a) the personal data are no longer necessary for the purpose for which they were collected or otherwise processed,

(b) in cases where personal data have been processed on the basis of consent and that consent to the processing of personal data has been withdrawn, where there is no other legal basis for the processing of personal data or other lawful exception;

(c) where the data subject objects to the processing of personal data on the basis of a legitimate interest and there are no overriding legitimate grounds for processing or the data subject objects to direct marketing;

(d) the personal data are processed unlawfully;

(e) in order to comply with a legal obligation, the personal data must be erased,;

4) upon request, require ŽILÍKSTAV, s.r.o. to restrict the processing of personal data if:

a) the data subject objects to the accuracy of the personal data, during the period allowing ŽILÍKSTAV, s.r.o. to verify the accuracy of the personal data;

(b) the processing of the personal data is unlawful and the data subject objects to the erasure of the personal data and requests instead the restriction of their use;

c) ŽILÍKSTAV, s.r.o. no longer needs the personal data for the purpose of processing the personal data, but the data subject needs them to assert a legal claim;

5) file a petition for initiation of proceedings with the Office for Personal Data Protection of the Slovak Republic.

The data subject shall be entitled to make a request in relation to the above-mentioned rights to the responsible person info@zilikstav.sk, or in person or by post to the address of the controller. In the subject line of both the e-mail and the letter, it is necessary to indicate the Privacy Policy „Cookie“.

Replies to those requests by the data subject or action taken on those requests shall be provided free of charge. If the request of the data subject is manifestly unfounded or unreasonable, in particular due to its repetitive nature (repeated request), ŽILÍKSTAV, s.r.o. shall have the right to charge a fee taking into account its administrative costs of providing the information or a reasonable fee taking into account its administrative costs of notifying or taking the requested action, or shall have the right to refuse to act on such a request.
